NON-DISCRIMINATION NOTICE & LANGUAGE ACCESS SERVICES

1. Our Commitment to Equal Access

Victory Healthcare Services, LLC (“VHCS”) complies with applicable federal and Maryland civil rights laws and does not discriminate on the basis of race, color, national origin, ancestry, age, sex, gender identity or expression, sexual orientation, disability, religion, or any other characteristic protected by law.

VHCS provides free aids, services, and language assistance to people with disabilities and to people who need language assistance — so that they can communicate effectively and participate fully in our services.

 

2. Federal Legal Basis

Section 1557 of the Affordable Care Act (ACA)

VHCS is a covered entity under Section 1557 of the Affordable Care Act, 42 U.S.C. § 18116, and its implementing regulations at 45 C.F.R. Part 92. Section 1557 prohibits discrimination in health programs and activities on the basis of:

  • Race, color, or national origin (pursuant to Title VI of the Civil Rights Act of 1964)
  • Sex (pursuant to Title IX of the Education Amendments of 1972), including pregnancy, gender identity, and sex characteristics
  • Age (pursuant to the Age Discrimination Act of 1975)
  • Disability (pursuant to Section 504 of the Rehabilitation Act of 1973)

Americans with Disabilities Act (ADA)

Under Title III of the ADA, 42 U.S.C. §§ 12181 et seq., VHCS does not discriminate on the basis of disability in the full and equal enjoyment of its services, programs, and activities. We provide reasonable modifications to policies, practices, and procedures for individuals with disabilities and ensure effective communication through appropriate auxiliary aids and services.

Title VI of the Civil Rights Act of 1964

VHCS does not discriminate based on race, color, or national origin in any program or activity receiving Federal financial assistance. This applies to all services and programs operated by VHCS.

 

3. Maryland State Law

In addition to federal law, VHCS complies with the following Maryland civil rights protections:

Maryland Fair Employment Practices Act

Md. Code, State Gov’t §§ 20-601 et seq. — Prohibits employment discrimination based on race, color, religion, sex, age, national origin, marital status, sexual orientation, gender identity, disability, or genetic information.

Maryland Equality Act / CFEPA

Md. Code, State Gov’t §§ 20-301 et seq. — Prohibits discrimination in public accommodations, including healthcare facilities, based on race, sex, disability, national origin, sexual orientation, gender identity, and other protected characteristics.

Maryland Disability Discrimination

Md. Code, State Gov’t §§ 20-701 et seq. — Prohibits disability discrimination in services open to the public, including healthcare services.

Code of Maryland Regulations (COMAR)

Behavioral health providers licensed under COMAR 10.21 are required to maintain non-discriminatory admission, services, and staffing practices.

 

4. Language Access Services — Free of Charge

VHCS provides language assistance services free of charge to individuals who are not proficient in English (Limited English Proficiency, or “LEP”), so that they can effectively access and participate in our services.

Available Language Services

  • Oral interpretation services: We provide access to qualified interpreters for in-person appointments, telephone communications, and telehealth sessions. There is no charge for this service.
  • Written translation: Key documents (including intake forms, consent forms, and service summaries) are available in languages other than English upon request.
  • Bilingual staff: Where available, we will connect you with bilingual staff who speak your language.

5. Auxiliary Aids and Services for Individuals with Disabilities

VHCS provides appropriate auxiliary aids and services to ensure effective communication with individuals who are deaf, hard of hearing, blind, have low vision, or have other communication disabilities. These include:

  • American Sign Language (ASL) interpretation (in-person or via video remote interpreting)
  • Real-time captioning (CART) services upon request
  • Printed materials in accessible formats (large print, electronic formats compatible with screen readers)
  • TTY/TDD access: TTY: Use Maryland Relay Service at 7-1-1
  • Website designed to meet WCAG 2.1 Level AA accessibility standards (see Accessibility Statement)

Please contact our office in advance of your appointment to request auxiliary aids or services so that we can make appropriate arrangements.

 

6. Reasonable Modifications

VHCS will make reasonable modifications to its policies, practices, and procedures to avoid discrimination on the basis of disability, unless doing so would fundamentally alter the nature of the goods, services, or facilities we provide.
